§ 1 Scope & provider
These Terms and Conditions apply to all purchases of digital content and services through the web shop of SkyCPvP, operated by [Vor- und Nachname / Firmenname], [Straße und Hausnummer], [PLZ] [Ort]. A consumer within the meaning of these terms is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
§ 2 Subject matter of the contract
The subject matter of the contract is the sale of digital, virtual goods and services for use exclusively on the Minecraft server SkyCPvP (e.g. ranks and credits). These are digital contents that are not delivered on a physical data carrier. There is no entitlement to permanent availability of the server or individual features.
§ 3 Conclusion of contract
The presentation of products in the shop does not constitute a legally binding offer, but an invitation to order. By clicking the "Order now (payment required)" button, you submit a binding offer to purchase. The contract is concluded as soon as we confirm the payment or provide the service.
§ 4 Prices & payment
All prices are final prices. Gemäß §19 UStG wird keine Umsatzsteuer berechnet. As these are digital services, no shipping costs apply. Payment is made via PayPal. The amount is due upon completion of the payment process.
§ 5 Delivery / provision
The digital service is generally provided automatically or promptly after receipt of payment to the game account specified in the purchase (Minecraft name). Please make sure you provide the correct Minecraft name. If you have problems with the provision, please contact [[email protected]] or our Discord support.
§ 6 Right of withdrawal & early expiry
Consumers have a statutory right of withdrawal (see Withdrawal Policy). For contracts for the supply of digital content not on a physical data carrier, the right of withdrawal expires early if we have begun performance after you (1) expressly agreed that we may begin performance before the end of the withdrawal period, and (2) confirmed that you thereby lose your right of withdrawal (§ 356 (5) BGB).
§ 7 User obligations
The user undertakes not to provide false information, not to abuse the payment process (e.g. no unauthorized chargebacks / no chargeback fraud) and to comply with the server rules. In the event of violations, purchased services may be withdrawn without refund.
§ 8 Liability
We are liable without limitation for intent and gross negligence as well as for injury to life, body or health. Otherwise, we are only liable for breach of a material contractual obligation (cardinal obligation) and limited to the foreseeable damage typical for the contract. Any further liability is excluded to the extent permitted by law.
§ 9 Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Should any provision of these terms be invalid, the validity of the remaining provisions shall remain unaffected. This site is not affiliated with Mojang AB or Microsoft.
